alhikmah.ac.id- ancangan Undang-Undang Penghapusan Kekerasan Seksual (RUU P-KS) menjadi sorotan banyak pihak karena isinya dinilai berpotensi memberi ruang bagi perilaku seks bebas.
Setelah terlibat dalam beberapa kali pembahasan akhirnya Fraksi PKS memutuskan menolak draf RUU ini.
“Pimpinan Fraksi PKS memutuskan untuk menolak RUU PKS ini dan akan memerintahkan Poksi 8 untuk menindaklanjutinya secara teknis,” tegas Sekretaris Fraksi PKS Sukamta melalui siaran pers Jumat (01/02/2019) di Jakarta.
Alasan PKS menolak RUU ini, menurut Sukamta, sekilas tujuan RUU ini nampak baik yaitu untuk melindungi perempuan dan anak dari berbagai tindak kekerasan seksual. Namun setelah dipelajari lebih dalam, ada yang secara makna dan tafsiran bertentangan dengan nilai-nilai Pancasila dan norma-norma agama.
“Fraksi PKS tidak serta merta menolak. Dalam perjalanan pembahasan RUU ini Fraksi PKS telah mengajukan empat poin perubahan yang dianggap penting dan mendasar,” terangnya
Sukamta menjelaskan, empat poin perubahan itu adalah pertama, pergantian nomenklatur ‘kekerasan seksual’ menjadi ‘kejahatan seksual’, agar memiliki ketegasan derajat hukum yang berat.
“Istilah kejahatan seksual menggambarkan unsur kesalahan dan derajat tindak pidana yang lebih tegas sehingga dapat mempermudah dalam perumusan delik dan pemenuhan unsur-unsur pidana dalam pembuktian,” ujar Sukamta.
Istilah ‘kejahatan seksual’ juga lebih memenuhi kriteria darurat kejahatan seksual, yang sedang terjadi di masyarakat. Di samping itu istilah ‘kejahatan seksual’ juga sudah digunakan dalam Undang-Undang Perlindungan Anak.
Usulan perubahan yang kedua, lanjut Sukamta, adalah perubahan definisi dari ‘kekerasan seksual’ itu sendiri.
“Definisi yang dirumuskan dalam RUU yang ada sekarang masih ambigu, sehingga menimbulkan keraguan dan ketidakjelasan. Di antaranya dengan tidak memperhitungkan resiko korban dapat kehilangan nyawa dari tindakan kejahatan seksual; memasukkan unsur hasrat seksual yang luas yang dapat berimplikasi pada sikap permisif terhadap perilaku seksual menyimpang, juga karena menggunakan istilah ‘relasi kuasa’ yang dapat disalahpahami dengan ‘relasi suami-istri’,” kata Sukamta lebih jauh.
Berkaitan dengan peran Pemerintah, FPKS mengusulkan juga untuk memasukkan klausul langkah-langkah preventif terhadap kejahatan seksual. Di antaranya dengan mewajibkan kepada pemerintah untuk memerangi pornografi, peredaran ilegal narkotika, zat psikotropika, serta minuman keras sebagai bagian yang tidak terpisahkan dari upaya pencegahan kejahatan seksual.
“Fraksi PKS juga mengajukan untuk menambahkan nilai Ketuhanan Yang Maha Esa menjadi asas pertama dalam Rancangan Undang-undang tersebut,” tambahnya.
Fraksi PKS berpandangan menjadi penting untuk menggunakan pendekatan ketaatan terhadap agama sebagai salah satu perspektif dalam pencegahan kejahatan seksual.
“Ketaatan terhadap ajaran agama yang dianut akan menimbulkan kesadaran hakiki seseorang untuk senantiasa berbuat baik dan menghindari perbuatan-perbuatan yang merendahkan martabat seseorang karena dianggap sebagai perbuatan dosa,” imbuhnya.
Sukamta menyayangkan keempat poin perubahan tersebut tidak terakomodasi dalam RUU hingga pembahasan terakhir.
“Sesuai dengan semangat UUD Negara Republik Indonesia 1945 dan Pancasila maka FPKS dengan tegas menolak RUU ini demi tetap terjaganya NKRI dan terjaganya moral bangsa kita di masa sekarang dan masa yang akan datang,” pungkas wakil rakyat dari Dapil Daerah Istimewa Yogyakarta ini.
